ARISE Lawn Service Terms of Service

1. Acceptance of Terms

By using the services provided by Arise Lawn Service ("we," "us," "our"), you ("client," "you," "customer") agree to be bound by the following Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue the use of our services.

2. Scope of Services

​

Arise Lawn Service offers lawn care services, including but not limited to mowing, weed control, fertilization, and specialized lawn projects such as sports fields and golf courses. The specific services provided to each client will be outlined in the service agreement, which may be adjusted from time to time as agreed upon by both parties.

3. Service Scheduling

​

  • Regular Maintenance: Services will be performed on a schedule mutually agreed upon by Arise Lawn Service and the client. This schedule may be adjusted due to weather conditions or other unforeseen circumstances.

  • One-Time Services: For clients requesting a one-time service, the scheduled date and time will be confirmed after service booking.

  • Delays and Rescheduling: If Arise Lawn Service must reschedule due to weather or other factors, the client will be notified, and services will be rescheduled at the earliest convenient time.

4. Pricing and Payment Terms

​

  • Pricing: Pricing for services will be communicated to the client prior to the commencement of work and will be based on the service package selected, property size, and the scope of services. Pricing for specialized projects will require a custom quote.

  • Payment Methods: Arise Lawn Service accepts payments via credit card, debit card, bank transfer, or other payment methods as specified on our website or in the service agreement.

  • Recurring Payments: For clients on subscription plans, recurring payments will be billed automatically on the agreed-upon schedule (monthly, quarterly, or annually).

  • Payment Due Date: Payments are due immediately upon completion of one-time services, or per the payment schedule for recurring services.

  • Late Payments: A late payment fee of 3% may be applied to invoices that are unpaid beyond the due date. ARISE Lawn Service reserves the right to suspend or terminate services if payment is not received.

5. Cancellation and Termination

​

  • Service Cancellation by Client: Clients may cancel or modify their services by providing written notice to ARISE Lawn Service at least three (3) days before the scheduled service. If proper notice is not provided, the client may still be charged for the scheduled service.

  • Service Termination by Arise Lawn Service: Arise Lawn Service reserves the right to terminate services if:

    • Payment has not been received after repeated attempts to collect;

    • The client has repeatedly failed to adhere to scheduling requirements;

    • The client’s property poses safety hazards to our staff or equipment;

    • Any other circumstances arise that make providing service impractical.

  • Refunds: No refunds will be given for services already rendered or for pre-paid subscription services, except where Arise Lawn Service fails to fulfill its obligations.

6. Client Responsibilities

​

  • Property Access: The client must provide Arise Lawn Service access to the property on the scheduled service date. If the property is inaccessible (e.g., locked gate, pets, etc.), services may be rescheduled, and additional fees may apply.

  • Pets: The client is responsible for securing pets during service. ARISE Lawn Service will not be held responsible for pets escaping or injuries caused by failure to secure them. Pet Waste: Please ensure your property is clear of pet waste prior to service.

  • Property Hazards: The client must inform Arise Lawn Service of any hazards on the property (e.g., sharp objects, uneven terrain) that could pose a danger to our staff or equipment.

7. Service Guarantees

​

  • Quality of Work: Arise Lawn Service guarantees the quality of work performed. If you are not satisfied with the services provided, please notify us within 48 hours, and we will work to resolve the issue.

  • Service Limitations: ARISE Lawn Service is not responsible for damage to underground utilities, sprinkler systems, or other property features that are not clearly marked by the client.

8. Liability

​

  • Injury or Damage: ARISE Lawn Service is fully insured and will be liable for injury or damage to persons or property resulting from negligent actions of our staff. However, we will not be liable for damage to property resulting from unmarked or hidden hazards, or for damages caused by the client’s failure to comply with these Terms.

  • Force Majeure: ARISE Lawn Service will not be held liable for delays or failure to perform services due to circumstances beyond our control, including but not limited to weather, natural disasters, labor strikes, or power outages.

9. Privacy Policy

​

ARISE Lawn Service respects the privacy of our clients. Any personal information collected will be used solely for the purpose of providing lawn care services and will not be shared with third parties unless required by law. For more details, please refer to our Privacy Policy.

10. Changes to Terms

​

Arise Lawn Service reserves the right to modify these Terms at any time. Clients will be notified of any changes via email or website update. Continued use of our services after changes are made constitutes acceptance of the updated Terms.

 

11. Governing Law

​

These Terms shall be governed by and construed in accordance with the laws of the state of Kansas where Arise Lawn Service operates, without regard to its conflict of law provisions.
